What data do we process from the User?

The Website itself does not collect personal data from the User. However, if participating in the Foundation’s program as a collaborator or potential beneficiary, the Foundation or its collaborators may request the minimum data necessary to organise collaboration, draft relevant donation contracts or accessory documents, and fulfil legal obligations.

The Foundation expressly reserves the right to unilaterally modify, in whole or in part, the amount or content of the data that may be required, with no obligation to notify or communicate this to the Users of the Website, as updates on the Website itself are considered sufficient.

In addition to providing the User with updates to this Privacy Policy, the User acknowledges and agrees that it is their responsibility to review this Privacy Policy with each interaction on the Website.

Why do we process Users' personal data, and what is the purpose?

We will process the data provided by Users to achieve the following objectives:

  • Manage their registration and participation in vehicle donations for those affected by the DANA in Valencia, whether through cash donations or vehicle donations.
  • Handle any requests, suggestions, or queries as a beneficiary or collaborator related to our Website and program.
  • Send communications via email or phone to provide information requested through contact forms linked to the Website.
  • Comply with applicable legal obligations.

What is the legal basis for processing Users' personal data?

The legal basis for processing personal data is the consent the User provides by accepting this privacy policy and participating in the program.

To whom do we disclose Users' personal data?

Your data will not be transferred to third parties outside the Foundation's collaborators in the donation program, except when expressly indicated, required by law, or to protect our rights. In certain cases, and as permitted by applicable law, the Foundation may be required to disclose personal data to comply with legal obligations, such as meeting tax authorities’ requirements or requests from law enforcement authorities, or to protect the Foundation's legal rights, such as defending a legal claim where allowed by applicable law.

Will international data transfers occur?

No international transfers of the User’s personal data will occur to countries outside the European Economic Area or International Organisations from countries outside the European Economic Area.

How long will we retain Users' personal data?

Personal data will be kept only as long as necessary to fulfil the purposes for which it was collected or while legal obligations require its retention, to determine potential liabilities derived from those purposes and data processing. Once no longer needed, it will be deleted with the relevant security measures to ensure anonymisation or complete destruction.

What are the User's rights?

The User has the right to access their data, as well as to rectify, transfer, and delete it, restrict certain data processing activities, object to them, and exercise the right to data portability.

The Foundation is committed to respecting the confidentiality of the User's personal data and ensuring the exercise of their rights.

The User is informed that they may exercise, at any time, the following rights by sending an email to donacionesdana@fundaciongarciaperalta.org, providing a copy of their ID or other sufficient identification document, and indicating the reason for the request and the right they wish to exercise.

In particular, regardless of the purpose or legal basis for processing, the User has the right to:

  • Be informed concisely, transparently, in an accessible, clear, and simple language, about the use and processing of their data.
  • Request access to their data held by the Foundation.
  • Request correction of any data. By actively providing their personal data through any means, the User guarantees its accuracy and agrees to notify any changes or modifications.
  • Request deletion of data when it is no longer necessary for the intended purposes or there is no longer a legal basis.
  • Request restriction of data processing, allowing in certain cases to temporarily suspend processing or retain data beyond the necessary time if needed.
  • Object to the processing of their personal data, including profiling.
  • Exercise their right to data portability, allowing them to receive it in a structured format and transfer it to another data controller, if possible.

If the User has given consent for any specific processing, they have the right to withdraw it at any time. However, withdrawal will not affect the legality of the prior processing based on consent.

The User has the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects or similarly affects them significantly. This right is excepted in the following cases:

  • When necessary for the conclusion or performance of a contract between the data subject and a controller.
  • When authorised by Union or Member State law applicable to the controller and which also provides suitable measures to safeguard the rights.
  • When explicit consent has been given.

If the User feels their data protection rights have been violated, especially if unsatisfied with the exercise of their rights, they may file a complaint with the competent Data Protection Authority via its website: www.aepd.es.

2. SECURITY MEASURES

In compliance with current data protection regulations, the Foundation meets all GDPR and LOPD requirements for processing personal data within its responsibility and strictly adheres to the principles outlined in Article 5 of the GDPR, ensuring data is processed lawfully, fairly, and transparently, as well as adequate, relevant, and limited to what is necessary for the purposes for which it is processed.

The Foundation guarantees it has implemented appropriate technical and organisational policies to apply the security measures established by GDPR and LOPD to protect the rights and freedoms of Users, preventing data loss, alteration, and/or unauthorised access by third parties. The necessary information has also been communicated to allow them to exercise their rights.
